These Terms of Service (“Terms”) govern your access to and use of artiFACTS, including our website, applications, and related services (collectively, the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian.

You agree that the information you provide is accurate and kept up to date.

2. Accounts and Responsibilities

You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

You may not share your account or allow others to access it except where explicitly permitted by your subscription tier.

We may suspend or terminate accounts that violate these Terms or misuse the Service.

3. Membership Tiers and Feature Access

artiFACTS offers multiple membership tiers, each with defined features, limits and usage allowances. These may include limits on:

  • Number of items stored or processed
  • AI assisted analyses, classifications or enrichments
  • Export, sharing or publishing features
  • Storage duration or retention
  • API or advanced tooling access

Tier details are described on our pricing or plan comparison pages and may change over time.

You agree to use the Service within the limits of your selected tier. Attempts to bypass usage limits or abuse system resources may result in throttling, suspension or termination.

4. Subscriptions, Billing and Cancellations

Paid subscriptions are billed in advance on a recurring basis (monthly or annually) through third-party payment processors such as Stripe.

Subscriptions automatically renew unless canceled before the end of the current billing period. You may cancel at any time, and access will continue until the end of that period.

Fees are non refundable except where required by law. We may change pricing or features with reasonable advance notice.

5. User Content and Ownership

You retain ownership of content you upload to the Service, including images, descriptions, metadata and annotations (“User Content”).

By uploading User Content, you grant artiFACTS a non exclusive, worldwide, royalty free license to store, process, analyze and display that content solely for the purpose of operating, maintaining and improving the Service, including AI assisted features.

You represent that you have the legal right to upload and use all User Content.

6. AI Assisted Features

artiFACTS uses automated and AI assisted systems to analyze, classify, enrich or suggest information about User Content.

AI generated outputs are provided for informational and reference purposes only and may be inaccurate, incomplete or speculative. They should not be relied upon as authoritative, professional or factual determinations.

You remain responsible for reviewing and verifying any AI generated information before use or sharing.

7. Data Use and Privacy Alignment

Our collection and use of personal data are governed by our Privacy Policy.

User Content may be processed by automated systems as described in these Terms and the Privacy Policy. We do not sell User Content or personal data.

Nothing in these Terms expands our data usage beyond what is disclosed in the Privacy Policy.

8. Prohibited Use

You agree not to:

  • Upload unlawful, infringing or abusive content
  • Use the Service for illegal, deceptive or harmful purposes
  • Attempt to reverse engineer, scrape or disrupt the Service
  • Circumvent usage limits, tier restrictions or access controls
  • Upload content you do not have rights to use

We reserve the right to remove content or restrict access for violations.

9. Intellectual Property

All software, branding, interfaces and service content provided by artiFACTS are owned by us or our licensors.

These Terms grant you a limited, non transferable, revocable license to use the Service in accordance with your subscription tier.

10. Availability and Changes

We strive to keep the Service available but do not guarantee uninterrupted access.

We may modify, suspend or discontinue features, tiers or functionality at any time. Where practical, we will provide notice of material changes.

11. Termination

You may stop using the Service at any time.

We may suspend or terminate access if you violate these Terms, misuse the Service or if required by law.

Upon termination, access to features and stored content may be limited or removed in accordance with your tier and retention policies.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind.

We do not guarantee that the Service will meet your needs, that AI outputs will be accurate or that content will always be preserved.

13. Limitation of Liability

To the maximum extent permitted by law, artiFACTS shall not be liable for indirect, incidental or consequential damages arising from your use of the Service.

Our total liability shall not exceed the amount paid by you to artiFACTS in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless artiFACTS from claims arising out of your use of the Service, User Content or violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.
